In 2024, pass the (BACS) decree—with honors!

European code name: BACS. French code name: BMS. It refers to a decree requiring the installation of building automation and control systems in tertiary-sector buildings by the end of 2024. While it is an additional constraint for logistics real estate stakeholders, it can also represent an opportunity to help achieve the energy-consumption reduction targets set by the tertiary-sector decree.

Having entered into force in July 2020, the BACS decree, for Building Automation and Control System, requires by the end of 2024 the installation of automation and control systems, also known as Building Management Systems (BMS), that reduce energy consumption in all tertiary-sector buildings with heating/cooling capacity above 290 kW. “According to the Xerfi research firm, fewer than 6% of tertiary-sector buildings are currently equipped with a BMS, says Benjamin Audibert, Development Director at E’nergys, a national player in overall sustainable performance. And 70% of these BMS have been deemed inoperative or poorly operated by Ademe’s study, ‘Assessment of BMS in the tertiary sector’.”

Interoperable with the building’s various technical systems, a BMS can nevertheless manage energy-intensive equipment by analyzing energy production and consumption data, then adjusting it accordingly. It must also make it possible to benchmark the building’s energy performance against reference values, detect efficiency losses in technical systems, and inform the building operator so that the situation can be analyzed and energy efficiency improved. “BMS is the fastest way to achieve the consumption-reduction targets set by the tertiary eco-energy decree, Benjamin Audibert recalls. It also enhances the value of real estate assets by making them less energy-intensive—generating 10% to 40% energy savings—and reduces building operating costs by optimizing how equipment operates and by taking account of external data, such as contract pricing and weather conditions.”

Opportunities offered by the BACS decree

As an obligation of means rather than results, the BACS decree provides for no penalty in the event of failure to comply with the obligations set out in the legal text. However, it is closely linked to the tertiary-sector decree, since both share the same objective of reducing buildings’ energy consumption. In this respect, non-compliance can lead to “name and shame” (public disclosure of offenders), as well as a fine of up to €1,500 for individuals and €7,500 for legal entities. Taking the risk of a penalty when compliance with the decree can itself represent an opportunity would nevertheless be regrettable.


In addition to helping secure environmental certifications such as BREEAM or HQE, these installations can also help warehouse managers in their day-to-day work. “For those with several tenants, Benjamin Audibert explains, BMS makes it easy to determine who consumed what and in what quantity, and therefore to bill each party based on actual consumption.” Although implementation costs have no longer been covered by the CEE (Energy Savings Certificates) in logistics since January 1 (unlike office, healthcare, and education buildings), Benjamin Audibert concludes by noting that energy production from photovoltaic panels can be integrated into the BMS, fully in line with Afilog’s announcement of the deployment of some 5 million square meters of photovoltaic panels within five years.

Les entrepôts de Kuehne+Nagel en France sont-ils tous équipés d’un système de gestion technique du bâtiment (GTB) ?

Nous avons deux cas de figure au niveau de notre parc d’entrepôts en France. Il y a ceux que nous exploitons en étant chez le client quand ce dernier est locataire ou propriétaire du bâtiment. Cela concerne une vingtaine d’entrepôts. L’équipement avec un système de gestion technique du bâtiment (GTB) dépend alors de notre client ou de son propriétaire, et nous n’avons pas la photographie exacte. Et il y a les 19 entrepôts dont nous sommes locataires en direct. Ce parc est très diversifié, avec des bâtiments déjà équipés de GTB (à l’image de ceux frigorifiques), et d’autres plus anciens qui ne le sont pas. Nous avons signé des conventions avant le 31 décembre 2023 pour l’équipement de GTB de classe A dans les bâtiments que nous exploitons et qui n’étaient pas encore équipés, ce qui nous permet de bénéficier des mesures d’accompagnement mises en place en France et au niveau de l’Union européenne pour être en conformité avec le décret BACS d’ici le 1er janvier 2025.

Comment mettez-vous ces entrepôts en conformité concrètement ?

Nous nous sommes donnés une année. Pour commencer, nous avons contacté les bailleurs de nos entrepôts à équiper avec des GTB de classe A pour savoir s’ils avaient prévu de procéder à des installations ou bien si nous nous en chargions. Nous intervenons donc sur une dizaine de site. Une fois les conventions d’équipement signées, nous avons lancé une campagne d’audits à compter de janvier. Elle s’achèvera en mars et mobilise des ingénieurs qui se déplacent dans chaque bâtiment pendant une ou deux journées. Ce travail va nous permettre de dimensionner le besoin et d’adapter parfaitement la GTB de classe A aux caractéristiques de chaque entrepôt. Nous prévoyons ensuite des installations entre mai et juin. S’en suivra une période de formation aux niveaux local, régional et national pour avoir un pilotage efficace et être en mesure de faire des comparaisons. Les bonnes pratiques pourront ainsi être appliquées sur chaque site. La mise en exploitation pleine et entière est programmée dans le courant du mois d’octobre.

Quel type de GTB allez-vous installer ?

Nous avons été très sollicités en 2023 par les installateurs. Nous avons opté pour des GTB allemandes de grande qualité afin de faciliter le suivi et le partage d’informations avec les bailleurs. Nous serons donc au rendez-vous le 1er janvier 2025. Et même s’il n’y avait pas eu le décret BACS, nous aurions équipé tous nos entrepôts en location directe avec des GTB de classe A dans le cadre de notre stratégie ESG.
